被警察拦下与法律:查证件、拒绝搜车、要律师、罚单与申诉

被警察拦下(pull over)在美国是很常见的事,绝大多数只是交通违章,不会有人被逮捕。真正容易出事的不是英文不好,而是动作做错:手往座位下面伸、开门下车、跟警察争辩。
先记住拦车时的标准动作,这几条比任何句子都重要:

要出示驾照和注册卡,这是法律要求。 License and registration, please. 这句话你必须配合——出示证件和不回答其他问题是两回事,这个区分一定要清楚。开车上路,出示驾照和车辆注册卡是规定动作;除此之外的问题,你有权不回答。
拦车时警察常说的四句:

Am I free to go?—— 问这句,警察就必须明确回答你能不能走。这是拦车里最有用的一句话。Am I being detained?—— 问清性质:是普通问话,还是被扣住了。两者你的权利不一样。I do not consent to a search.—— 不同意搜查,要说清楚、语气平静,必要的时候重复说。
关于宪法权利,最常被引用的两条是:
- 第五修正案(Fifth Amendment) 里有不得自证其罪的权利。你可以说
I'm going to remain silent.或I'd like to speak to a lawyer. - 第四修正案(Fourth Amendment) 涉及搜查。你可以拒绝同意搜查——
I do not consent to a search.
但有几件事必须搞清楚,否则会误判自己的处境:
- 你一旦同意(consent),搜查就是合法的。 所以「不同意」这句话要说出口,不能沉默。
- 警察有
probable cause(合理根据)或者拿到搜查令(warrant)时,可以搜,不需要你同意。 - 车里的隐私期待比家里低。 同样是搜,车和家的规则不一样。
- 这些规则各州不同。 民事交通违规和刑事案件的界限也各州不同——
This varies by state, so know your state's rules.遇到具体事情找当地律师,别靠网上的说法。
Miranda warning(You have the right to remain silent…)是逮捕之后才念的,普通拦车问话时不会有。所以不要以为没听到 Miranda 就说明自己没被逮捕——判断标准是你是否可以自由离开,所以才要问 Am I free to go?
最后是罚单。警察给的那张纸叫 citation(也叫 ticket)。签字只是承诺出庭或者交罚款,不等于认罪,警察递给你的时候通常就会说明这一点。罚单上写着 court date。你有三条路:

开车被拦下,出示驾照和注册卡

口语小注
1. officer 是称呼,不是名字。
Evening, officer. / Thank you, officer. 是最标准的称呼方式。不确定性别时说 officer 永远安全,比 sir / ma'am 更保险。不要叫 hey、buddy、man。
2. No, sir, I don't. 这三截是刻意的。
不要只摇头或者说 Nope.。明确说出口很重要——车里有录音,警察的报告里会写「司机口头回答了什么」。同样的道理,Yes, sir. / No, sir. 这种简短正式的答法在被拦下时是合适的,不会显得巴结。
3. Am I free to go? 是拦车里最有用的句子。
问这句会逼出一个明确答复:要么放你走,要么告诉你被扣住了。如果对方说你可以走,你就走;如果对方说不可以,那就是被 detained 了。 这句话本身就是判断处境的方法。
4. 不要解释、不要争辩、不要编理由。
I was watching the exit signs, not my speed. 这种承认疏忽的说明是安全的;There's no way I was going that fast 这种争辩毫无用处——测速是警察说的,你在路边赢不了这场辩论,要争也是上庭争。
5. 书面警告(written warning)比罚单轻,但它不是零。
written warning 没有罚款、不记点,保险公司一般也看不到,但警察系统内部会留记录。同一个路段短期内再犯,通常就不会再是警告了。

口语小注
1. I do not consent to a search. 要说出来,不能沉默。
这是这一节最重要的一句话。沉默不等于拒绝——如果警察问「我可以看看吗」,你不说话或者含糊其辞,事后很难说清你到底同不同意。所以要用清楚、平静、完整的句子说出来,必要时重复说同一句,不要换词、不要吵。
2. 同意之后就不能反悔了。
Go ahead. / Sure. / I guess so. 这些都是同意。一旦同意,搜查就是合法的,搜出来的东西也能用。所以不确定的时候,标准回答只有一个:I do not consent to a search.
3. probable cause 是「合理根据」,不是「怀疑」。
警察不需要你同意也能搜车的两种常见情形是:有 probable cause,或者拿到了 warrant(搜查令)。所以「我不同意」并不能阻止一切搜查,它阻止的是仅凭你同意才成立的那种搜查。这个区别要清楚,不然会误判自己的处境。
4. 车里的隐私比家里弱。
同样是搜查,车和家的规则不一样——这是美国判例法里很明确的一点。所以在车里拍视频、放东西,期待值要放低。各州在细节上还有差别,This varies by state, so know your state's rules.
5. 态度平静比说什么都重要。
It's not personal. / That's your call. 这类句子能把你从「对抗」拉回「配合但保留权利」。几乎所有的麻烦都来自动作和语气,而不是句子本身——手放在方向盘上、语气平稳、重复同一句话,这是最安全的组合。

口语小注
1. Miranda warning 是逮捕之后才念的。
You have the right to remain silent… 这一整套叫 Miranda warning,逮捕(arrest)之后才会有。普通拦车问话时警察不会念,这很正常,不代表你没有权利,也不代表你已经被逮捕。判断自己到底处于什么状态,靠的是 Am I free to go? 和 Am I being detained?
2. I'd like to speak to a lawyer. 要说得简单、重复。
不要长篇解释「我觉得我需要法律咨询」。短句、重复、语气不变是最有效的:I'd like to speak to a lawyer. 说完之后,对方再问什么,你就重复这一句,或者 I'm going to remain silent. 说三遍、五遍都不算失礼。
3. 你没有义务「配合调查」来证明自己清白。
美国这套制度里,举证责任在控方,你不需要自证清白。侦探剧里那种「老实交代就能早点回家」的桥段,在现实里对你没有任何法律保障。要求律师、保持沉默,是行使权利,不是心虚。
4. 千万不要动手、不要跑、不要推。
I'm not going to resist. 这句话配合双手放在看得见的地方、按指令转身,能避免绝大部分危险。跟警察有肢体冲突在美国是非常严重的事,任何情况下都不要跑。
5. 事情结束后立刻联系律师,别自己上网查。
This varies by state, so know your state's rules. 这句不是客套——搜查、拦车、罚单的具体规则各州差别很大,朋友的经验、网上的帖子都不一定适用于你所在的州。真出了问题,找当地律师,很多律师做初次咨询是不收费的。

1. 签字不是认罪,但你必须签。
警察递罚单让你签字,这一签是承诺出庭或者按时处理,不是承认违法。警察一般会主动说明 It's not an admission of guilt. 拒签通常没有好处,还可能多一条麻烦。签完拿好那张纸,上面的编号是后面所有事情的钥匙。
2. 直接交钱 = 通常认了。
pay the fine 最省事,但代价是记点(points)会进你的记录,保险费可能因此涨好几年。所以先算一笔账:罚款是一次性的,保险涨价是长期的。这也是为什么很多人宁愿上庭或者上课。

口语小注
1. 法官的称呼只有一个:Your Honor。
不要叫 Judge、Sir、Mr.。开场回答用 Yes, Your Honor.,结束时说 Thank you, Your Honor. 就够。说话要简短,法官问什么答什么,不要主动讲一大段。
2. 先承认事实,再讲情节,这是最有效的顺序。
I don't dispute that I was going over the limit. 先说这句,法官立刻知道你讲道理,后面的情节他才愿意听。反过来一上来就说「我没超速」,在没有证据的情况下只会失去可信度。
3. 「我不是想完全脱掉」是一句很有用的话。
I'm not asking to get out of it. I'm asking whether the court would consider a driving course. 这句话把请求变得具体、合理、可操作。法官每天听太多「我没错」,听到一个明确、可行的请求,通常更愿意给方案。
4. 上课的证书要交回法院,不是 DMV。

发音与语调提示
1. I do not consent to a search. 要慢、要清楚,不要连读。
